Terms of service.
These terms govern your use of Oye Hello. By creating an account or placing a call through the platform, you agree to them.
1. Who these terms are with
The service is provided by TODO — registered legal entity name, TODO — registered office address (“we”, “us”). “You” means the business or person using the service. If you are accepting on behalf of a business, you confirm you are authorised to bind it.
2. Your account
- You are responsible for keeping your credentials secure and for activity under your account.
- The details you give us at sign-up must be accurate and kept up to date.
- You must be able to enter a binding contract, and be acting for a business.
3. Calling rules and consent
This is the part that matters most, because the consequences of getting it wrong fall on you. You are solely responsible for the lawfulness of every call your agents make or receive.
- You must have a lawful basis to contact every number you dial, and must honour any do-not-disturb or do-not-call registration, and any applicable telecom regulations on commercial communications.
- You must tell your callers what they need to know about the call — including, where required, that they are speaking to an automated agent and that the call is recorded or transcribed — and obtain any consent the law requires.
- You must not use the service for fraud, impersonation, harassment, or to place calls that would be unlawful if a person made them.
- You are responsible for the content of your agent's instructions and for what it tells your callers.
4. Acceptable use
You must not:
- Resell or provide the service to a third party except as their agent;
- Reverse engineer the platform, or probe or bypass its security or tenant isolation;
- Upload content you have no right to use, or that infringes anyone's rights;
- Use the free demo agents other than to evaluate the product, or attempt to defeat their per-number limits;
- Place a load on the service designed to degrade it for others.
5. Your content
The documents you upload, the agent profiles built from them, and your call transcripts remain yours. You grant us only the licence needed to run the service for you: to store and process that content, and to pass it to the infrastructure and model providers listed in our privacy policy. We do not use it to train general-purpose AI models.
You confirm you have the right to upload what you upload, and that using it as agent knowledge does not breach anyone else's rights.
6. What the agents do and do not guarantee
The agents generate speech using language models. They work from the profile built out of your documents, and are instructed not to invent prices or make promises your policies do not support — but no language model is perfect, and output can still be wrong.
You should review your call transcripts and keep a human in the loop for anything consequential. Nothing an agent says constitutes professional, legal, financial or medical advice, and in regulated contexts you must route decisions to a qualified human.
7. Third-party model providers
If you supply your own model API keys, those calls run on your account with that provider, under their terms and their pricing, and you are responsible for that relationship.
8. Trials and fees
Free test calls are provided so you can evaluate the service, subject to the limits shown in the console, and we may change or withdraw them. Where paid terms apply, they are the ones agreed with you in writing.
9. Availability
We work to keep the service available and will give notice of planned maintenance where we can, but we do not guarantee uninterrupted service unless we have agreed a service level with you in writing. Telephony depends on carriers outside our control.
10. Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these terms — particularly the calling rules in section 3 — or where we must to comply with the law or protect the service. On termination your content is deleted in line with the retention periods in our privacy policy.
11. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost business or lost data, and our total liability arising out of the service is limited to the amounts you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
You will indemnify us against claims arising from your use of the service in breach of these terms, including claims brought by people your agents called.
12. Changes
We may update these terms. We will change the date at the top of this page and, where the change is significant, tell account holders directly. Continuing to use the service after a change means you accept it.
13. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute.
